Terms of Service
These Terms of Service govern your use of Transni (the "App" or "Service"). Please read them carefully. By using the App, you affirmatively accept these Terms. If you do not agree, do not use the App.
1. Use of the App
By using the App, you consent to our processing of data as described in our Privacy Policy. You agree to use the App only as permitted by these Terms and applicable law. The App may communicate with our servers to operate, update, and improve the App. We may modify or discontinue the App (or any features) at any time.
2. Eligibility
The App is intended for users age 13 and older. If you are under 18, you represent that you have permission from a parent or legal guardian to use the App.
3. Your Content
You retain ownership of content you submit. You grant Transni a worldwide, non-exclusive, royalty-free license to use, host, store, and process your content solely to provide and improve the App and to comply with law. You represent that you have all rights necessary to submit your content and that it does not violate any law or third-party rights.
4. Acceptable Use
You agree not to misuse the App, including by engaging in unlawful, harmful, abusive, or disruptive activities; infringing intellectual property or privacy rights; distributing spam or malicious content; or attempting to bypass security or technical restrictions.
5. Third-Party Services
The App may rely on third-party services. Those services may be governed by their own terms and policies, and we are not responsible for them.
6. Paid Features
The App is currently offered without charge. We may introduce paid features, subscriptions, or in-app purchases in the future. If offered, applicable pricing, billing terms, renewal terms, and cancellation instructions will be presented before purchase.
Purchases processed by a third-party app store are also subject to that store's billing, subscription, and refund terms. Except where required by law, fees are non-refundable and pricing may change prospectively.
7. Feedback
If you provide suggestions or feedback, you grant Transni the right to use it without restriction or compensation.
8. Disclaimers
The App is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Translations may be inaccurate or incomplete. Do not rely on the App for high-stakes decisions.
9. Limitation of Liability
To the maximum extent permitted by law, Transni will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Transni's total liability for any claim is limited to the greater of $100 or the amount you paid to Transni in the 12 months before the claim arose.
10. Indemnification
You agree to defend, indemnify, and hold harmless Transni from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your content, or your violation of these Terms.
11. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects your rights.
Informal resolution: Before filing a claim, you agree to contact us at [email protected] and allow 30 days to resolve the dispute informally.
Arbitration: Any dispute arising out of or relating to these Terms or the App will be resolved by binding arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association (AAA) under its rules. The arbitration may be conducted by telephone, video, or in Washington State, unless we agree otherwise.
Class action waiver: You and Transni agree that each party may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
Small claims: Either party may bring an individual claim in small claims court if it qualifies, provided the claim remains in that court and on an individual basis.
Opt-out: You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms. If you opt out, the class action waiver still applies to the fullest extent permitted by law.
Severability: If any part of this section is found unenforceable, the remaining parts will remain in effect. If the class action waiver is found unenforceable, the arbitration requirement will not apply to that dispute.
12. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, except that the Federal Arbitration Act governs arbitration.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. We may provide additional notice for material changes. By continuing to use the App after an update, you agree to the revised Terms.
